1. Definitions

In these Terms & Conditions, the following definitions apply unless the context clearly requires otherwise:

2. Acceptance of Terms

2.1 By accessing the phiery Platform, creating an Account, or placing any wager or bet, you confirm that you have read, understood, and accepted these Terms & Conditions in full, including the phiery Privacy Policy and Responsible Gaming Policy, both of which are incorporated herein by reference.

2.2 If you do not agree with any part of these Terms, you must immediately cease using the Platform and close your Account. Continued use of the Platform following any amendments to these Terms constitutes your acceptance of the revised Terms.

2.3 These Terms constitute a binding legal agreement between you and phiery. They govern every interaction you have with the Platform, including but not limited to account management, financial transactions, game participation, and communications with phiery support staff.

3. Eligibility

3.1 To register and use the phiery Platform, you must satisfy all of the following eligibility requirements at all times:

• You must be at least 21 years of age;
• You must be a natural person (not a corporation, partnership, or other legal entity);
• You must have the full legal capacity to enter into a binding contract under Philippine law;
• You must not be a resident of, or accessing the Platform from, any jurisdiction where online gambling is prohibited by applicable law;
• You must not be subject to any self-exclusion order applicable to the phiery Platform or any PAGCOR-administered exclusion register;
• You must not be an employee, officer, director, contractor, or immediate family member of phiery or any affiliated entity.

3.2 phiery reserves the right to request documentary proof of eligibility at any time. Failure to provide satisfactory documentation within the timeframe specified by phiery may result in Account suspension or closure.

4. Account Registration

4.1 Each Player is permitted to maintain only one (1) Account on the phiery Platform. The creation of multiple accounts by a single individual is strictly prohibited and will result in the closure of all associated accounts and forfeiture of any balances therein.

4.2 During registration, you must provide accurate, current, and complete information, including your full legal name, date of birth, residential address, and a valid email address or Philippine mobile number. You are responsible for keeping this information up to date.

4.3 phiery reserves the right to decline any registration application at its sole discretion, without obligation to provide reasons.

4.4 You are solely responsible for maintaining the confidentiality of your phiery login credentials. You must not share your username, password, or OTP codes with any third party. Any activity conducted through your Account is your responsibility, regardless of whether it was authorized by you.

4.5 If you suspect unauthorized access to your Account, you must notify phiery support immediately via live chat. phiery will investigate and may temporarily suspend the Account pending resolution.

5. KYC Verification

5.1 phiery is required to conduct identity verification (KYC) on all Account holders in accordance with applicable Philippine law and PAGCOR guidelines.

5.2 KYC verification is mandatory before any withdrawal can be processed from a phiery Account. You may be required to provide:

• A government-issued photo identification document (e.g., Philippine passport, driver's license, UMID, SSS ID, PhilHealth ID, or Voter's ID);
• Proof of residential address (e.g., a utility bill or bank statement dated within the past 90 days);
• Proof of the payment method used for deposits (e.g., a screenshot of the GCash account showing the registered mobile number matching the Account details);
• A recent selfie photograph for facial verification purposes.

5.3 phiery reserves the right to request additional documentation at any time, including as part of enhanced due diligence procedures for high-value accounts.

5.4 phiery may suspend withdrawal processing pending the completion of KYC verification. The Company will use reasonable efforts to process KYC submissions within 2–5 business days of receipt of complete documentation.

6. Deposits

6.1 All deposits to the phiery Platform are conducted in Philippine Peso (PHP / ₱). phiery does not accept deposits in foreign currencies.

6.2 Accepted deposit methods include GCash, PayMaya, BPI, BDO, Metrobank, and UnionBank, subject to availability. phiery reserves the right to add or remove accepted payment methods at any time.

6.3 Deposits made via GCash and PayMaya are typically credited to the phiery Wallet within seconds of authorization. Bank transfer deposits are subject to the processing times of the sending institution and may take up to one (1) business day.

6.4 phiery does not impose deposit fees. However, your payment provider may apply its own transaction charges, for which phiery bears no responsibility.

6.5 You must only deposit funds that you legally own and that derive from legitimate sources. Deposits made using payment methods registered in a name other than your own registered phiery Account name may be declined or subject to enhanced verification.

7. Withdrawals

7.1 Withdrawal requests may only be submitted in respect of funds that constitute your own verified real-money balance. Bonus Funds that have not yet met applicable wagering requirements are not eligible for withdrawal.

7.2 All withdrawal requests are subject to completed KYC verification as described in Section 5. phiery will not process withdrawals to Accounts that have not completed KYC.

7.3 Withdrawals will only be processed to payment accounts registered in your own name, corresponding to the identity documents provided during KYC verification. phiery does not process withdrawals to third-party accounts.

7.4 GCash and PayMaya withdrawals are typically processed within 5 to 30 minutes of approval. Bank transfer withdrawals are subject to the receiving institution's processing schedule and may take up to one (1) business day.

7.5 phiery reserves the right to impose a reasonable maximum withdrawal limit per transaction or per rolling 24-hour period, as communicated in the Platform's banking section. Higher limits may be available to VIP tier members subject to enhanced verification.

7.6 In cases where phiery has reasonable grounds to suspect fraudulent activity or a breach of these Terms, withdrawal processing may be suspended pending investigation.

8. Bonuses & Promotions

8.1 phiery may, from time to time, offer bonuses, free bet credits, reload bonuses, cashback, and other promotional incentives to eligible Account holders. Each bonus or promotion is governed by its own specific terms, which are communicated at the time of the offer and must be read in conjunction with these Terms.

8.2 Unless stated otherwise, Bonus Funds are subject to a wagering requirement — the number of times the bonus amount (and in some cases the deposit amount) must be wagered before a withdrawal of associated winnings may be requested. Wagering requirements applicable to each bonus will be clearly stated in the promotional terms.

8.3 Bonus Funds credited to your phiery Account have a limited validity period, as specified in the applicable promotional terms. Bonus Funds not used within the validity period will be forfeited without compensation.

8.4 The following conduct constitutes abuse of the phiery bonus system and is strictly prohibited:

• Creating multiple accounts to claim the same promotion more than once;
• Using bonus funds to place low-risk, offsetting, or arbitrage bets designed to satisfy wagering requirements without genuine gameplay risk;
• Coordinating with other players to pool bonus funds or exploit promotional mechanics;
• Any other conduct that phiery, in its reasonable judgment, determines to constitute bonus abuse.

8.5 phiery reserves the right to void any bonus, cancel any winnings derived from a bonus, and close any Account found to have engaged in bonus abuse.

9. Gameplay Rules

9.1 Each game available on the phiery Platform is governed by its own specific rules, which are accessible within the game interface. In the event of a conflict between game-specific rules and these Terms, the game-specific rules will prevail for matters directly related to gameplay mechanics, and these Terms will prevail for all account, financial, and conduct-related matters.

9.2 All games on the phiery Platform use certified Random Number Generator (RNG) technology where applicable. Live dealer games are operated by human dealers in purpose-built studios with multi-camera oversight. phiery does not manipulate game outcomes.

9.3 In the event of a technical malfunction — including but not limited to server disconnections, software errors, or power failures — during a game session, phiery will use all reasonable efforts to restore the game to its pre-malfunction state. If this is not possible, bets placed during the affected session may be voided and stakes returned to the Player's Wallet.

9.4 phiery's game results as recorded by our servers constitute the official record for all gameplay activity. In the event of a dispute between a Player's local device display and phiery's server records, phiery's server records will be determinative.

10. Prohibited Conduct

10.1 The following conduct is strictly prohibited on the phiery Platform. Engaging in any of the following may result in immediate Account suspension or permanent closure, forfeiture of any account balance, and referral to appropriate Philippine law enforcement or regulatory authorities:

• Providing false, inaccurate, or misleading information during registration or KYC verification;
• Using the Platform while under the age of 21;
• Registering more than one (1) Account;
• Accessing the Platform using a VPN, proxy, or other technology to circumvent jurisdictional access restrictions;
• Using automated software, bots, scripts, or other artificial means to interact with the Platform;
• Engaging in money laundering, fraud, or any other illegal financial activity through the Platform;
• Exploiting software bugs, errors, or glitches in any game or the Platform;
• Harassing, threatening, or abusing phiery staff or other Players via any Platform communication channel;
• Engaging in any collusion with other Players in any game.

11. Responsible Gaming

11.1 phiery is committed to the promotion of responsible gaming practices. The Platform provides the following tools to all Account holders, accessible from the Account settings dashboard:

• Deposit Limits: Set daily, weekly, or monthly caps on deposits to your phiery Wallet;
• Loss Limits: Set a maximum amount you are willing to lose within a defined period;
• Session Time Reminders: Receive notifications at set intervals about time spent on the Platform;
• Reality Checks: Periodic in-session alerts displaying time elapsed and net gaming result;
• Self-Exclusion: Temporarily or permanently close your Account. Self-exclusion periods range from one (1) month to indefinite. Self-exclusion requests are irrevocable during the chosen exclusion period.

11.2 If you believe you or someone you know may have a problem with gambling, we strongly encourage you to contact phiery support to activate self-exclusion, and to seek assistance from relevant support services.

11.3 phiery enforces the 21-year age minimum strictly. If you are aware of a minor accessing the Platform, please report this to phiery support immediately.

12. Intellectual Property

12.1 All content on the phiery Platform — including but not limited to software, design elements, trademarks, logos, text, graphics, images, and game content — is either owned by phiery or licensed to phiery by its content providers. All rights are reserved.

12.2 You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for personal, non-commercial gaming purposes only. This license does not permit you to copy, reproduce, modify, distribute, or create derivative works from any Platform content.

13. Limitation of Liability

13.1 The phiery Platform is provided on an "as is" and "as available" basis. phiery makes no warranties, express or implied, regarding the Platform's uninterrupted operation, error-free performance, or suitability for any particular purpose.

13.2 To the maximum extent permitted by applicable Philippine law, phiery's aggregate liability to you for any claim arising from or related to the Platform shall not exceed the amount deposited by you into your phiery Wallet in the thirty (30) days preceding the event giving rise to the claim.

13.3 phiery shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits or loss of opportunity, arising from your use of or inability to use the Platform.

13.4 phiery shall not be liable for losses resulting from circumstances beyond its reasonable control, including but not limited to telecommunications failures, internet service disruptions, third-party payment provider outages, natural disasters, acts of government, or civil unrest.

14. Privacy

14.1 The collection, use, storage, and disclosure of your personal data by phiery is governed by the phiery Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also accept the terms of the Privacy Policy.

14.2 phiery processes personal data in compliance with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing regulations. Full details are available in our Privacy Policy.

15. Dispute Resolution

15.1 If you have a complaint regarding any aspect of the phiery Platform or these Terms, you should submit it to phiery support via live chat in the first instance, setting out the nature of your complaint clearly. phiery will use reasonable efforts to acknowledge all complaints within 24 hours and to resolve them within 10 business days.

15.2 phiery's decision on any complaint, communicated in writing, shall be final and binding subject only to any mandatory rights you may have under applicable Philippine consumer protection law.

15.3 phiery's game server records constitute conclusive evidence of all gaming transactions for the purposes of dispute resolution.

16. Amendments

16.1 phiery reserves the right to amend these Terms at any time. Material amendments will be communicated to Account holders via email or on-Platform notification at least seven (7) days prior to taking effect, except where immediate amendment is required by law or regulatory directive.

16.2 Your continued use of the Platform following the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must close your Account and withdraw any outstanding balance before the effective date of the amendment.

17. Governing Law & Jurisdiction

17.1 These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles.

17.2 Any dispute arising from or in connection with these Terms that cannot be resolved through phiery's internal complaint resolution process shall be subject to the exclusive jurisdiction of the competent courts of the Republic of the Philippines.
